New I-9 Form for August 1, 2023

New Announcement by DHS! On July 21, 2023, New I-9 Form with all the proposed changes. Effective August 1, 2023, Employers will use the updated version of the I-9 Form (Edition: 08/01/2023). Employers may continue using the prior version of Form I-9 (Edition: 10/21/2019) through October 31, 2023. The new I-9 Form is available effective 7/25/23.

E-Verify Employers

On July 21, 2023. the U.S. Department of Homeland Security (DHS) moved to modernize employment eligibility verification, taking additional steps to provide certainty and flexibility for American businesses. Rather than examining an employee's identity and employment authorization documents in person, employers who participate in E-Verify and are in good standing will have the option to conduct verification electronically and with a live video call interaction. This will be a different flexibility than what the current DHS has provided for Employers.

For Non-E-Verify Employers

On May 11, 2023, the President determined that the Covid-19 pandemic was no longer an emergency. As a result, that prompted The US Immigration and Customs Enforcement (ICE) to announce that “Normal Operations are Resumed”. Employers will have 30 days to comply with Form I-9 employment eligibility verification physical document examination requirements when COVID-19 flexibility end on July 31, 2023.

There will be no more extensions! Employers will have 30 days to review all the documents used during the Covid Pandemic flexibility decision on March 20, 2020.
